Mr Sheehy was subsequently suspended for a period of 14 days commencing midnight 23 April 2024. In determining penalty Stewards took into account Mr Sheehy’s prior record as well as the seriousness of the breach of the two rules in this event. Mr Sheehy was advised that should a repeat of an offence of this nature occur again in future, greater penalties would apply, as well as consideration made to the driver’s license. Stewards also considered their powers in relation to HR 66(i) and also HR 176(6)(b) taking into account the degree of the breach and margin, prior to giving all clear.
Stewards questioned Driver/Trainer T Sheehy in relation to the performance of FRANKIE J HOLDEN NZ ($126) who advised that the gelding was suited to today’s race, having found the outside leader’s position with little effort. T Sheehy further advised that the gelding performed very well at its last start on the 16 April albeit breaking gait at the start and believed that the gelding was a winning chance in tonight’s event. The Trainer advised that the stable did not support the gelding. A post-race sample was taken for analysis.
