SUPPLEMENTARY REPORT PENRITH 14/03/2024

RACE 2 – SKY RACING ACTIVE PACE – 1720 metres

SARA TA SLOY– Driver J Brown pleaded guilty to a charge under rule 163(2) in that shortly after entering the home straight he has allowed and urged SARA TA SLOY forward improving his position inside the line of marker pegs and he has failed to restrain his drive and return to the outside of the marker pegs at his first available opportunity. Mr Browns licence to drive in races was suspended for a period of 21 days which will commence midnight the 28th March 2024.

Mr Brown further pleaded guilty to a charge under rule 162(1)(d) for delaying the start in that he raised his hand after SARA TA SLOY galloped in the score up on the first occasion when believing his hopples required adjustment. During the delay Mr Brown adjusted the hopple length without gaining prior approval from the Stewards or Starter. Mr Brown was fined $300. In issuing this penalty Stewards were mindful of Mr Brown’s forthright evidence, his prior clear record and the circumstances of the rule breach.

Trainer F Taiba pleaded guilty to a charge under rule 239A for negligence in that when he packed the gear for SARA TA SLOY he packed the incorrect hopples for the filly and as a result the incorrect hopples were fitted and SARA TA SLOY was presented to race with the incorrect gear. Mr Taiba was fined $500.  In assessing penalty Stewards were mindful that upon review of the available evidence, which included wagering information, there was no evidence present to prove, or infer, this occurrence was anything more than an inadvertent error. Stewards further took into account Mr Taiba’s immediate admission of his error and his clear record with respect to like matters and his guilty plea.
