RACE 3 – MELBOURNE CUP @ CLUB PACEWAY NOV 1 PACE – 2125metres

MY BUZZ LIGHTNING NZ – Near the 300 metres checked and raced inside marker pegs as a result of FIFTEEN ACES and MANLY MACH locking wheels and losing ground. Prior to the declaration of the all-clear, Stewards considered if the gelding obtained an advantage to the detriment of any other runner whilst racing inside marker pegs. After taking evidence from Driver S. Arvidsson and reviewing the films it was established that whilst racing inside marker pegs the gelding maintained its position to the detriment of CEE FOR COLIN and DELIGHT N GOLD and as a result, Stewards relegated the gelding from 6th placing to 8th  placing. At a subsequent inquiry Driver S. Arvidsson pleaded guilty to a charge under Rule 163(2) in that once racing inside marker pegs she failed to sufficiently restrain the gelding prior to re-joining the field near the 250 metres. Driver S. Arvidsson was fined $200.

MANLY MACH – Prior to the declaration of all-clear Driver J. Gallagher of the 5th placegetter MANLY MACH elected to lodge an objection against the 4th placegetter FIFTEEN ACES alleging interference near the 450 metres. After taking evidence from Drivers J. Gallagher and N. Xuereb and reviewing the films it was established that near the 450 metres FIFTEEN ACES hung in and locked wheels with MANLY MACH and as a result that runner was checked and lost ground. Stewards after considering where the incident took place, the degree of interference and also the margin between both runners at the end of the race, were comfortably satisfied that had that interference not taken place that MANLY MACH would have finished in advance of FIFTEEN ACES and therefore the protest was upheld.
