It was established near the 100 metres WESTERN STYLE was taken wider away from FEAR CRUISINNZ which shifted out slightly. Then leaving the 50 metres, FEAR CRUISIN NZ shifted out marginallyresulting in WESTERN STYLE racing with its near side wheel behind the off side wheel of FEAR CRUISIN NZ over the concluding stages. Notwithstanding the movement of FEAR CRUISIN NZ, and the minor interference to WESTERN STYLE at the 100 metres,Stewards formed the view that the interference to WESTERN STYLE was minor. Furthermore, that had the interference not occurred WESTERN STYLE was not improving sufficiently to finish ahead of FEAR CRUISIN NZ. Consequently the protest was dismissed and the all clear was given on the judge’s numbers of 1-5-3-6.
