ROCK SUPREME- Pre race blood samples were obtained. Broke gait in the early stages of the score up and was a significant distance out of position at the start. A warning was issued. Improved three wide at the 950 metres before commencing to weaken leaving the 500 metres. Driver B McElhinney explained that after ROCK SUPREME broke gait in the early part of the score up he became frustrated and drove the gelding with vigour to race up onto the back of the field near the 1100 metres. Then, approaching the 950 metres he improved three wide in order to put ROCK SUPREME into the race however, leaving the 500 metres it became apparent that ROCK SUPREME was not responding to his driving and commenced to weaken. He added that it was always his intention to drive ROCK SUPREME forward at the start if the gelding did not break gait. After considering the evidence stewards issued a charge against B McElhinney under rule 149(2) for driving ROCK SUPREME in an unacceptable manner. The particulars being that after breaking gait and losing significant ground and being approximately 50 metres behind the main body of the field at the start he drove ROCK SUPREME with significant vigour to catch the field approaching the 1100 metres. B McElhinney then only afforded the gelding slight respite for approximately 150 metres before shifting the gelding three wide and driving him with vigour when there was an opportunity to remain racing in the running line or shift his runner down the track and improve along the marker pegs. Subsequently ROCK SUPREME was under pressure leaving the 500 metres and commenced to weaken. In assessing penalty consideration was given to B McElhinney’s overall driving record, forthright evidence and guilty plea and the fact that the veterinary examination of ROCK SUPREME revealed that the gelding was mildly lame in the off fore leg. B McElhinney had his licence to drive in races suspended for a period of 28 days.

Driver B McElhinney was issued with a charge under rule 218A(1) “A person shall not mistreat a horse”. The particulars being:

  • 1-After crossing the finish line with ROCK SUPREME B McElhinney restrained ROCK SUPREME sharply and turned that horse around acutely and hastily returned to the closed horse exit gait. ROCK SUPREME then took one slight backward step which saw B McElhinney strike the gelding with his whip on at least 3 occasions.
  • 2-– Upon returning to the race day tie up stalls B McElhinney, when unharnessing ROCK SUPREME, struck the gelding with a closed fist near the girth on the near side. In addition, B McElhinney then moved to the rear of the horse to continue unharnessing ROCK SUPREME at which point he struck ROCK SUPREME forcefully with a closed fist on the near side rump region.

Evidence was taken from stewards, the assistant starter Mr E Turner, club veterinarian Ms D Justus and CCTV was viewed. B McElhinney entered a guilty plea. In assessing penalty consideration was given to B McElhinney’s overall participation record within harness racing and his obvious contrition and guilty plea. In addition the stewards were mindful of what message is sent to the industry in respect to such conduct. Purpose of issuing such penalties as a protective measure for the image and interests of the harness racing Industry. B McElhinney had his licence to drive in races suspended for a period of 3 months. The suspensions were directed to be served culmatively. ROCK SUPREME was stood down pending a veterinary certificate of fitness.
