When queried regarding his tactics C Johnson (CROOKWELL JAKE) stated that pre-race he’d been provided with the option of pushing forward from the gate to gain a forward position of if the pace of the race was solid to restrain and come with one run.  C Johnson said it was the time he had driven the horse and Trainer Mr Loone had emphasised that CROOWELL JAKE could fire up and become keen in its races so where possible try and work with the horse rather than against it.  The instructions were confirmed by the Trainer pre-race as required.  The Driver explained that in running he had considered working forward three wide from the near the 700 metres but was conscious that both JULIUS FRANCO and VICTORY MEDAL NZ would come out under his drive and oblige it to race wide on the final turn.  He added that prior to the 300 metres he had considered following JULIUS FRANCO into the race but considering the compactness of the field had elected to instead shift to the back of SECRET JACK so as to use the sprint lane but in hindsight that horse might have started to lose momentum as he shifted.  After reviewing the official vision, considering the evidence and the circumstances of the race, Stewards determined that CROOKWELL JAKE had been driven in accord with the Rules.

The All-clear for this race was delayed to permit Stewards and the Driver D Girardi (second placed JULIUS FRANCO) to review the official vision in the final straight.  Although it was evident that the winner VICTORY MEDAL NZ had shifted marginally, the effect to JULIUS FRANCO was deemed insignificant.

GENERAL REPORT - RACE 7

Prior to the running of the race, it was noted that SECRET JACK (S Loone) and CROOKWELL JAKE (C Johnson) had entered the track earlier than the protocol and contrary to the direction of a Clerk of Course and Assistant Starter.  Stewards took the view that the Drivers had been properly instructed and their actions were a serious offence, particularly from a safety and welfare perspective, as at that time the Clerks of the Course, Ambulance attendants and Track attendants were not in place.

Driver C Johnson acknowledged his actions and was found guilty of an offence under Rule 238 in failing to comply with a direction.  He was fined $250 of which $150 was suspended on the condition that he not breach

the Rule again within the following twelve months.

Trainer/Driver S Loone who insisted it was a misunderstanding was found guilty of an offence under Rule 238 in failing to comply with a direction.  He was fined $250 of which $150 was suspended on the condition that he not breach the Rule again within the following twelve months.
